FRONT RUNNER COACHING WAIVER WARNING: Running, Swimming & Cycling are physically demanding sports that require training and fitness. They are recreational activities that involve a significant risk of impairment of a participant’s physical condition or injury and even death from various causes including exertion, environment, participants, spectators or other road/path/trail or track users. DECLARATION, WAIVER AND RELEASE: (*) PARENT OR GUARDIAN MUST AUTHORISE FOR ALL JUNIOR ATHLETES UNDER 18. By registering for any program, event, or coaching service provided by Seb Sports Pty Ltd t/as Front Runner Coaching, you confirm that you have read, understood, and agreed to the terms of this Participant Waiver and Release of Liability. 1. Acknowledgment of Risks: I, the undersigned participant (or parent/guardian if under 18), acknowledge that participation in running, triathlon, and related training activities involves inherent risks. These risks may include, but are not limited to, injury, illness, accidents, property loss, and, in rare cases, death. I understand that these risks may arise from my own actions or omissions, the actions or omissions of others, environmental conditions, equipment failure, or the condition of facilities or training locations. 2. Voluntary Participation: I voluntarily choose to participate in the coaching, training sessions, programs, and activities provided by Seb Sports Pty Ltd t/as Front Runner Coaching and acknowledge that I do so entirely at my own risk. 3. Scope of Services: I understand that Seb Sports Pty Ltd t/as Front Runner Coaching provides coaching services through both: • Employed coaches, who deliver training directly under the company’s supervision; and • Independent coaches or contractors, who utilise the company’s facilities, systems, and branding but operate as independent service providers responsible for their own professional conduct and client interactions. 4. Release and Waiver — Including Negligence: To the fullest extent permitted by law, including under section 139A of the Competition and Consumer Act 2010 (Cth) and applicable state and territory Civil Liability Acts, I hereby release and discharge Seb Sports Pty Ltd t/as Front Runner Coaching, its directors, employees, contractors, independent coaches, and affiliated entities (collectively “the Released Parties”) from all liability, claims, demands, actions, or causes of action for any personal injury (including death), loss, damage, or property damage suffered by me arising out of or in connection with my participation in any coaching or training activity, including where such injury, loss, or damage arises from the negligence of any of the Released Parties. This release does not exclude, restrict, or modify liability for conduct that is reckless, grossly negligent, or otherwise not lawfully excludable. 5. Independent Contractors: I acknowledge that independent coaches engaging or engaged by Seb Sports Pty Ltd t/as Front Runner Coaching are not employees or agents of the company. Each independent coach is responsible for their own advice, instruction, and duty of care. I agree that Seb Sports Pty Ltd t/as Front Runner Coaching is not liable for any act, omission, or negligence of an independent contractor. 6. Medical Fitness and Consent: I declare that I am medically fit to participate and that I have disclosed any relevant medical conditions to my coach and received medical clearance to participate from a qualified medical practitioner. In the event that I become aware of any medical condition, injury or impairment that may be detrimental to my health, I will seek immediate medical attention and receive clearance before resuming training participation. By continuing to participate in this activity, I accept the risks despite these conditions and still, and will always be under the terms of this agreement. 7. Risk Warning (as required by state and territory law): I acknowledge that the activities I am participating in are recreational services that involve significant physical exertion and risks of physical harm. I have been warned that I participate at my own risk and that the company and its coaches may not be liable for harm caused by negligence, under section 139A of the Competition and Consumer Act 2010 (Cth). 8. Use of Image and Data: I consent to Seb Sports Pty Ltd t/as Front Runner Coaching using photographs, videos, or data collected during training or events for legitimate business and promotional purposes, unless I notify the company in writing that I do not consent. 9. Indemnity: I agree to indemnify and hold harmless Seb Sports Pty Ltd t/as Front Runner Coaching, its staff, and contractors against any loss, damage, or legal costs arising from my participation, except to the extent caused by gross negligence or unlawful conduct. 10. Governing Law: This waiver and any dispute arising under it are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia. You waive any right to claim that proceedings should be conducted in any other jurisdiction. 11. Severability: If any part of this agreement is held to be invalid or otherwise unenforceable then that part will be deemed to be severed without affecting the enforceability of the remainder of this agreement. 12. Acknowledgment of Understanding: I certify that I am 18 years or older and have read this document and fully understand it OR As a parent or guardian of the participant under 18, I agree to the above for myself and on behalf of the participant and I indemnify and will keep indemnified any person or body directly or indirectly associated with the conduct of the activity or the terms referred to. 13. Changes: Seb Sports Pty Ltd t/as Front Runner Coaching may, from time to time, update the terms of its services, this waiver, or related disclaimers. Any updates will be published at: https://frontrunnersports.com.au/legal/ It is your responsibility to review these terms periodically. Your continued participation in, or use of, Front Runner Coaching services after any updates have been published constitutes your acceptance of the revised terms.
